Response to Call for Riverside County Police Review Commission

In response to the Riverside County Democratic Party's resolution that calls for the Board of Supervisors to appoint a police review commission to provide oversight for all law enforcement in the County, the Riverside Sheriffs’ Association issued the following statement. Preserving the peace is a cornerstone of our mission and is an integral component in the fabric of our democracy. Accomplishing that mission encompasses many strategies, which include building strong community partnerships, and preventing crime. Riverside County Sheriff Deputies are dedicated to serving the community protecting both life and property. We accomplish that mission daily in line with the directives given by both the Sheriff and political leadership of the County,  whether in daily police work or during times of unrest.  The belief that “civilian oversight commissions” are the great elixir to law enforcement oversight is greatly misplaced.  These commissions are often filled with political appointees who have little prior knowledge of the law enforcement work, even though they are empowered to second guess the actions of law enforcement.  In contrast, Sheriff Department detectives who investigate use of force by deputies are intimately familiar with the departments’ rules and regulations regarding use of force, and the training that deputies receive. The Riverside County District Attorney’s Office, which investigates all deadly uses of force and other uses of force if needed, is intimately familiar with the body of law which governs whether a use of force is a violation of criminal law.  In addition, there is an elected Sheriff who makes the ultimate...

RSA Statement on Matthew Keith Tucker Incident

A petition circulating online falsely claims that “Matthew Tucker was murdered by two Riverside police officers.” As a result of the online petition and accompanying misinformation being spread on social media as well as comments made at a recent Riverside County Board of Supervisors meeting regarding the 2016 incident, the RSA has issued the following statement: It’s important that factual information is provided so that actual facts are known.  After a thorough investigation into the deputy involved shooting, the Riverside District Attorney’s office conducted a complete review of the entire case for criminal culpability of the involved deputies. Upon completion of that independent review, the DA’s office declined to file criminal charges on any of the involved deputies.   The use of force by the deputies in the 2016 incident was found to be reasonable, and the tactics used before the shooting were appropriate. The claims in the online petition have been thoroughly aired in court before a jury and were rejected. In 2018, following a six-day civil trial in federal court, a unanimous jury found the deputies used reasonable force and that there was no negligence in the tactics used by the deputies. In rendering a unanimous verdict in favor of the deputies, the jury rejected all claims that the deputies had violated Mr. Tucker’s civil rights, used excessive force, or were negligent.

The election of the Sheriff for each County in California is enshrined in the California Constitution.  This ensures the Sheriff is accountable to the voters, via an election every four years or by a recall in the interim between elections.  In contrast, the Chiefs of Police in California serve at the whim of political officials or boards. As an independent and elected official, the Sheriff has the duty and responsibility to set and enforce policies in their department, including use of force policies.  The Riverside Sheriff’s Department Policies are readily available for public review and are posted on the internet.  No other entity, including the Board of Supervisors, can enact policy for the Sheriff’s Department.  Law enforcement across the nation and Sheriff Bianco have both condemned the use of force used against George Floyd.  The methods and force used by the Minneapolis Officers on George Floyd at the time of his death, are not allowed in Riverside County per existing Riverside County Sheriff’s Department policies. The grievances of the protesters need to be heard.  To those who are hurting, we are listening to you; we understand, and we too are hurting. We condemn all forms of racism and unnecessary uses of force. Statement on Enforcement of Stay at Home Order

Riverside, May 7, 2020 - The Riverside Sheriff's Association( RSA) supports Sheriff Bianco's continued decision not to enforce Riverside County's "Stay at Home" Orders with arrest.     Having suffered the loss of fellow Deputies Terrell Young and David Werksman to COVID-19, we understand the deadly nature of this virus. However, even though the virus is still present, the Governor has announced a four-phase framework for reopening California.  In contrast, the Riverside County Public Health Orders regarding the virus are far more restrictive than those statewide plans.   We agree with Sheriff Bianco that law enforcement should not be employed to enforce those more stringent orders. Understandably, many residents of our county are in strong disagreement with the Riverside County Public Health Orders. However, we believe that arresting people unnecessarily for violating the orders would be a waste of law enforcement resources, and would contribute to a breakdown in trust between law enforcement and the residents we serve. Finally, the RSA believes the Board of Supervisors should take action to rescind the current restrictive Riverside County guidelines and replace them with guidelines that align with those recommended by the State of California. Riverside Sheriffs' Association Mourns The Loss of Deputy David Werksman

Riverside, April 3, 2020 - For the second day in a row, the Riverside Sheriffs' Association (RSA) is mourning the loss of a Deputy due to Coronavirus. Deputy David Werksman served the Department and the Association for 22 years. His death due to COVID-19 is the latest excruciating loss as a result of the silent killer COVID-19 for our Association and the law enforcement community. His death is a grim reminder of the risks that our members face every day, serving the public in the face of this pandemic. We ask that the community keep Deputy Werksman's family and colleagues in their prayers during this extremely emotional and challenging time. It is hard to imagine that just 24 hours ago, our Department was in pain due to the COVID-19 death of Deputy Terrell Young. Our members are heartbroken and hurting. Deputy Werksman spent his life serving the community and working to make our Riverside County a better place. Deputy Werksman began his career with our Department on April 23, 1998, and worked assignments at the Robert Presley Detention Center, Jurupa Valley Station, Hazardous Device Team, Lake Elsinore Station, and was most recently assigned to Sheriff's Administration. He was a very accomplished Deputy and was an FBI Certified Public Safety Bomb Technician, had an advanced IED electronics certification, was a HAZMAT Specialist and Radiologic/Nuclear First Responder, was a confined space rescue certified, a Rangemaster, First Aid/CPR Instructor and advanced scuba certified, just to name a few of his accomplishments. We are selling K9 stuffed animals to benefit the Riverside County Sheriff’s Department K9 Team. Cost per each K9 stuffed animal is $20. All proceeds go to the K9 team. The Riverside County Sheriff's Department K9 Team is made up of twenty-eight deputies stationed across the county.   The Riverside County Sheriff's Department Canine Association is a non-profit organization who we are proud to be partnered with through the Riverside County Deputy Sheriff Relief Foundation. Through this partnership the goal is to educate and promote the use of police service dogs within the community, perform canine demonstrations for schools and community groups, and help provide additional training and equipment for police service dogs and their handlers. Donations for Robert Foley

From the family of Robert Foley: "Robert Allen Foley passed away while on vacation in Peru on 7/4/19. Rob left this world doing what he loved and that was living life to the fullest, not letting a moment go to waste. Rob graduated from the Sheriff’s academy on 10/30/08, but he wore many other hats in his short life of 47 years. Rob was a skydiver, a pilot, an artist, played an acoustic guitar and he rocked an electric. Rob was a jokester, a comedian, should have been a race car driver, an amazing cook, classic car collector, dog lover and the most amazing Son, Brother, Uncle and Friend. Rob had so many amazing adventures and awesome stories to tell with them. Rob traveled to many countries and tasted many foods and beverages to please his intrinsic palette. Every trip Rob took, he made sure to bring back a souvenir for everyone. Rob loved his friends and family, he would help anyone in need at any moment, he knew no strangers.  Of course we are biased, being his family, but he truly was an amazing guy and extremely humble. There have been so many people sharing how Rob helped them in a difficult time and he never told us these stories. We have been so grateful for all of the love and support from his work family, you are all very special people. This is a very difficult time, but we find some peace in hearing all the stories and pictures...
